Public Offer (Terms of Service)

This Public Offer (hereinafter referred to as "Terms") constitutes a legally binding agreement between You and the Company regarding Your use of the Service (Website and Courses). By accessing or using the Service, including purchasing or accessing any Course, You signify Your acceptance of and agreement to be bound by these Terms. If You do not agree to these Terms, You must not access or use the Service.

1. Service Description: The Company provides access to online educational Courses focused on the game of checkers via its Website. Access typically requires Account registration and payment for specific Courses.

2. Account Registration: To access most features, You must register for an Account. You agree to provide true, accurate, current, and complete information during registration and maintain/update it. You are responsible for safeguarding Your password and for all activities that occur under Your Account. You must notify Us immediately of any unauthorized use of Your Account.

3. Course Purchase and Access:
   - Upon successful payment for a Course, the Company grants You a limited, non-exclusive, non-transferable, revocable license to access and view the purchased Course content solely for Your personal, non-commercial, educational purposes via the Service, subject to these Terms.
   - Payments are processed through secure third-party payment providers (e.g., Stripe). By providing payment information, You represent and warrant that You are authorized to use the designated payment method. All prices are listed in EUR (Euros) and are inclusive of VAT where applicable unless stated otherwise. You are responsible for any applicable taxes based on Your location.

4. Intellectual Property Rights: The Service and all its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) and all Course materials are owned by the Company, its licensors, or other providers of such material and are protected by Polish and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows: Your computer may temporarily store copies incidental to accessing/viewing; You may store files automatically cached by Your Web browser; You may download/print a reasonable number of pages for Your own personal, non-commercial use related to the Course and not for further reproduction/distribution. You must not delete or alter any copyright/trademark notices.

5. User Conduct and Restrictions: You agree not to use the Service:
   - In any way that violates any applicable national or international law or regulation.
   - For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
   - To transmit, or procure the sending of, any "junk mail," "chain letter," "spam," or any other similar solicitation.
   - To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
   - To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by Us, may harm the Company or users or expose them to liability.
   - Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any material.
   - Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
   - Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
   - Share Your Account login credentials or allow others to access Courses through Your Account.

NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE OR COURSES. WITHOUT LIMITING THE FOREGOING, NEITHER THE COMPANY NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT THE SERVICE OR COURSES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE OR COURSES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. Governing Law and Jurisdiction: All matters relating to the Service and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the Republic of Poland without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the competent courts located in Warsaw, Poland. However, this choice of jurisdiction does not deprive consumers residing in other EU countries of the protection afforded to them by mandatory provisions of the law of their country of residence.
9. Changes to Terms: We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. However, any changes to the dispute resolution provisions set forth in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual notice on or before the date the change is posted. Your continued use of the Service following the posting of revised Terms means that You accept and agree to the changes.
